Racketeering & RICO Defense in Midland

Federal Court Experience for Complex State & Federal Charges

Texas Engaging in Organized Criminal Activity and federal RICO charges involve separate legal frameworks, but both can turn allegations about multiple people and offenses into a far more serious prosecution. Eckman Law Firm, PLLC defends clients in Midland against these complex charges by examining the conduct and evidence attributed to each person.

Our attorneys bring experience from several sides of the federal criminal process. Aaron E. Eckman served as an Assistant Criminal District Attorney before clerking for a U.S. Magistrate Judge. He is admitted in the Western, Northern, and Southern Districts of Texas and before the Fifth Circuit Court of Appeals. Victoria Eckman has represented clients in federal jury trials, suppression hearings, and detention hearings involving serious criminal charges.

Texas Engaging in Organized Criminal Activity Charges

Texas prosecutes racketeering-related conduct under its Engaging in Organized Criminal Activity statute rather than federal RICO. Under Texas Penal Code § 71.02, prosecutors generally must allege that a person intended to establish, maintain, or participate in a combination or its profits, or acted as a member of a criminal street gang or foreign terrorist organization, while committing or conspiring to commit an enumerated offense.

Enumerated offenses include murder, aggravated robbery, aggravated assault, aggravated sexual assault, theft, certain drug offenses, fraud, and bribery. The alleged underlying offense affects both what the prosecution must prove and the degree of the charge.

What Qualifies As a Criminal Combination?

A criminal combination consists of at least three people who collaborate in carrying on criminal activities. Participants don’t have to know every other participant’s identity, and membership can change over time.

Texas courts also require continuity. The evidence must support an alleged intent to work together in a continuing course of criminal activity, not merely participation in one isolated joint offense. Communications, timelines, relationships, and each person’s alleged conduct can therefore be central to the defense analysis.

Charge Levels Under Texas Law

Engaging in Organized Criminal Activity is generally charged one category higher than the most serious predicate offense. If that offense is a Class A misdemeanor, the allegation becomes a state jail felony. The exact charge level and potential punishment depend on the crime identified by the prosecution.

A prosecution can continue even if another alleged participant hasn’t been prosecuted, has been acquitted, or isn’t criminally responsible for the object offense. Texas law generally permits the case to proceed when at least two people allegedly remain involved in a continuing course of conduct.

Federal RICO Charges & Conspiracy Allegations

The federal Racketeer Influenced and Corrupt Organizations Act is codified at 18 U.S.C. §§ 1961 through 1968. Section 1962 addresses investing racketeering income in an enterprise, acquiring or maintaining control of an enterprise through racketeering, conducting an enterprise through a pattern of racketeering activity, and conspiring to commit those acts.

A federal RICO pattern requires at least two acts of racketeering activity within 10 years of each other. That numerical threshold is only part of the analysis. The government’s theory must connect the alleged acts to the charged enterprise and satisfy the other applicable elements.

What a RICO Conspiracy Allegation Requires

A RICO conspiracy allegation focuses on an agreement to further a scheme that would satisfy the statute’s elements. Prosecutors don’t have to prove that a defendant personally committed two predicate acts or took an overt act to advance the conspiracy. Defense preparation can therefore turn on what the defendant allegedly agreed to, not simply whether the person committed a particular crime.

A federal RICO violation can carry up to 20 years of imprisonment per count. A life sentence can be authorized when the charge is based on a predicate offense with a maximum penalty that includes life imprisonment. The potential range in an individual case depends on the counts, predicate offenses, applicable federal sentencing law, and case-specific facts.

State & Federal Racketeering Proceedings in Midland

The charges filed and jurisdiction asserted determine whether an accusation proceeds in Texas state court or federal court. Midland County is part of the Midland-Odessa Division of the U.S. District Court for the Western District of Texas, which holds court in Midland. A state case follows Texas criminal law and procedure, while a federal RICO prosecution proceeds under federal statutes and court rules.

The sentencing stakes also differ. For Texas Engaging in Organized Criminal Activity tied to a first-degree felony, subject to specified statutory exceptions, the punishment range is life or 15 to 99 years in prison. Charges based on other predicate crimes are classified according to the enhancement structure in the Texas statute.

Our federal court background allows us to address the procedural and evidentiary demands of these prosecutions. Aaron’s judicial clerkship provided firsthand insight into federal court procedure, while Victoria’s work includes federal trial, suppression, and detention proceedings.

Preparing a Racketeering or Organized-Crime Defense

We begin by separating broad allegations about a group from the evidence attributed to the individual client. Multi-defendant cases can involve extensive communications, financial records, surveillance, witness statements, and digital evidence. We examine what each item establishes, who it concerns, and whether it supports the prosecution’s organizational theory.

Our evaluation may address:

  • The alleged combination: Whether a Texas case shows a continuing collaboration rather than one isolated joint offense.
  • The claimed enterprise: Whether the federal evidence establishes the enterprise described in the indictment.
  • The alleged pattern: Whether the predicate acts form the pattern of racketeering activity required under federal law.
  • The underlying offense: Whether the evidence supports the separate crime on which the state or federal allegation depends.
  • Individual involvement: Whether statements and records connect the client to the charged conduct or agreement.

Our attorneys work directly with clients to shape defense strategy. When the facts require additional investigation, we can retain a private investigator to develop evidence for negotiation, trial preparation, or mitigation. That work may involve locating witnesses, examining disputed events, or testing assumptions in the prosecution’s account.

Our firm has obtained grand jury no-bills and dismissals in serious felony cases. Past results don’t predict what can happen in another case, but they reflect detailed factual investigation and case-specific preparation.
